Impeachment is political and, yes, legal

This is a second column of The Corona Trial Scorecard, a series I am writing on the Corona impeachment trial now that is currently ongoing in the Senate. I began the series with a review of the experience of judicial experience in the United States. In this column, with the research and drafting assistance of Danielle Mae Navarro, a UP Law student, I review the Philippine impeachment procedure as laid down by the 1987 Constitution. A review of this procedure, and in particular its genesis and history in the debates of the Constitutional Commission that drafted the Constitution in 1986, clearly shows that impeachment is both political and legal. It is political in that the persons and institutions tasked with impeachment duties are political, but it is legal because rules, including the Bill of Rights, apply and cannot be wantonly disregarded.

Judicial Impeachment: The U.S. Experience

With this column, I begin The Corona Trial Scorecard, a series of columns on the Corona impeachment trial now on its way in the Senate. I begin this week with two background columns – the first one is this column on impeachment in the United States (which I co-write with a member of my legal research team of UP Law students, Marianne Sibulo) and the next on the procedure for impeachment (written also with the help of Danielle Mae Navarro, also a member of my legal research team).

The Arroyo Chronicles: Introduction

With this column, I begin a new series on the legal travails of former President Gloria Macapagal Arroyo. I write this series here in The Lobbyist on the issue an events surrounding the criminal charges filed (and will be filed) against the former President for its historical, political and yes human interest value. This can be a good moment for the country in exacting accountability from its leaders but, as I have written elsewhere, it can also be a night mare where a conviction is a consequence of a lynch mob mentality (making it a precedent for violating human rights) or an acquittal is because of bad and incompetent prosecution or worse a biased judiciary.
